JUDGEMENT
Ashwani Kumar Mishra, J. -
(1.) Following orders were passed in the matter on 26.8.2019:-
"Petitioner is aggrieved by an order of suspension dated 17.10.2018 as also its continuance on the ground that neither any charge sheet has been served nor the proceedings have been concluded. It is also stated that the charges are absolutely vague and even in the event it being established would not warrant imposition of major punishment. Submission is that rule 4 of the U.P. Government Servant (Discipline and Appeal) Rules, 1991 has been violated. Reliance is placed upon judgment of the Apex Court in Ajay Kumar Choudhary Vs. Union of India and another, 2015 7 SCC 291, according to which suspension ought not to be continued for indefinite period.
Learned Standing Counsel may obtain instructions in the matter, by the next date fixed.
Put up as fresh on 9.9.2019."
(2.) Learned Standing Counsel has obtained instructions, according to which a chargesheet has already been served to the petitioner on 17.10.2018. Copy of the instructions have been furnished to counsel for the petitioner today in Court.
(3.) Sri S.K. Dubey, learned Additional Chief Standing Counsel states that in case a short opportunity is granted, the disciplinary authority shall ensure expeditious conclusion of the enquiry itself.;
