- (1.) Heard Sri Y.S. Sachan, learned counsel for the petitioner and Sri Mata Prasad, learned Standing Counsel for the State-respondents.
(2.) The present petition seeks to challenge the order dated 15.03.2007 passed by the respondent no.3-Controlling Authority/Deputy Labour Commissioner, U.P., Kanpur Region, Kanpur determining the amount of gratuity payable to respondent no.1-workman.
(3.) This petition has been filed primarily on the ground that retirement benefits payable to the employees of the Nagar Nigam are governed in terms of the Retirement Benefits and General Provident Fund Regulations, 1962 applicable to the employees of the Nagar Nigam, and the Payment of Gratuity Act, 1972 would not be applicable.;
