JUDGEMENT

(1.) Heard learned counsel for the petitioner, Sri Manjiv Shukla, learned Addl. Chief Standing Counsel for the opposite party No. 1 and Sri Ratnesh Chandra, learned counsel for the opposite party Nos. 2 and 3.

After hearing learned counsel for the parties and going through the record, the position which emerges out is to the effect that the petitioner No. 1-St. Xaviers Day School (in short 'School') is in the city of Lucknow and the school building was constructed over a Plot bearing No. B-1/36 situated at Sector-D, LDA Colony, Kanpur Road, Lucknow. The plot over which the school is situated is earmarked for residential purposes and in view of the same, the concerned authorities passed the order(s) dated 30.01.2006, 02.05.2006, 09.05.2006, 31.05.2006 and 14.09.2006.

A Writ Petition No. 4906 (MS) of 2006 (Ashok Karnwal and another v.State of U.P. and others) was filed by the petitioner No. 2 before this Court, thereby challenging the order dated 30.01.2006 was passed by the Prescribed Authority, Lucknow Development Authority (LDA) and the order dated 02.05.2006 passed by the Commissioner, Lucknow Division/Chairman, LDA and the order dated 14.09.2006, passed by the Secretary, Govt. of U.P. rejecting the revision of the petitioner and also the orders dated 31.05.2006 and 09.05.2006 related to closure of school being run by the petitioners over a residential Plot No. B-1/36 situated at Sector-D, LDA Colony, Kanpur Road, Lucknow, was dismissed vide order dated 28.05.2019, passed by this Court. The relevant portion of the order dated 28.05.2019 reads as under:-
"58. This Court does not therefore find any good ground to show interference in the orders impugned. There is no challenge to the findings of fact recorded in the orders impugned relating illegal construction being raised by the petitioners over the plot in question in a residential area.
59. The writ petition being devoid of merits is dismissed. This Court having not interfered with the orders impugned, it is expected that the LDA will ensure their compliance. ;
