SUNITA AGARWAL,J. - (1.) Heard learned counsel for the parties and perused the records.
(2.) A counter affidavit has been filed on behalf of the respondent on 13.03.2019, the same has been perused.
(3.) Admitted facts of the matter are that the Original Suit No.39 of 2010 (Abhinandan Kumar Shinghai v. Kastur Chandra and others) had been proceeded exparte on 14.11.2011, after recording satisfaction with regard to the service of notice/summons on the defendants. However, it was dismissed for want of prosecution on the part of the plaintiff vide order dated 03.12.2012.;
