JUDGEMENT

Rajesh Singh Chauhan,J. - (1.) Heard learned counsel for the parties.
(2.) This Court has passed order dated 09.04.2019, which is being reproduced here-in-below:- "Heard Sri Amit Bose learned counsel for the petitioner and the learned State Counsel who has accepted notices on behalf of the opposite parties 1 to 4. At present notices to opposite parties 5 to 7 are dispensed with. The learned counsel for the petitioner has submitted that the impugned order of suspension has been passed by an authority who is not competent to do so in view of the U.P. Police Ministerial Accounts and Confidential Assistant Cadres Service Rules, 2015 whereas as per the provisions of Rule 3(b) it has been specifically provided that the appointing authority in case of a person holding the rank of Sub Inspector (such as the petitioner) will be the Deputy Inspector General of Police whereas the impugned order has been passed by the Superintendent of Police. Learned counsel for the State submits that the impugned order has been passed after taking due approval from the appointing authority and seeks two days' time to seek instructions in the matter with regard to such approval. However the effect of the aforesaid approval will also be required to be seen on account of the specific mandate of the rules that the order is required to be passed by the appointing authority. List this case on 11th April, 2019 as a fresh case in order to enable the learned counsel for the opposite parties to obtain instructions in the matter."
(3.) In compliance of the aforesaid order, Sri Ran Vijay Singh, learned Additional Chief Standing Counsel has submitted that he has received the complete instructions in the matter and produced a copy of instructions dated 10.04.2019 before the Court, which is taken on record.;
