Ajit Kumar, J. - (1.) Heard learned counsels for the parties.
(2.) By means of this writ petition, the petitioners have challenged the propriety and legality of the order passed by the Assistant Registrar, Varanasi passed in purported exercise of power under Section 13-A read with Section 13-B of the Societies Registration Act, 1860 as applicable in the State of Uttar Pradesh.

Briefly stated facts are that the petitioners who are having a Society registered under the Societies Registration Act, 1860 (for short Act, 1860) are taking plea of the renewal of registration of the Society as is required under the U.P. amendment to the central Act. While the question of renewal of the registration was engaging the attention of the Registrar Societies, a complaint came to be made by the third respondent before the Assistant Registrar, Societies, Varanasi for cancellation of the registration of the Society taking recourse to Sections 12-B and also, at the same time, requiring the audit of the accounts of the Society as prescribed under Section 24 of the Societies Registration Act.;
