JUDGEMENT

(1.) HEARD Sri Prashant Chandra, Senior Advocate, assisted by Sri Anurag Verma, learned counsel for the petitioner, learned Additional Chief Standing Counsel for opposite party no.1 and Sri Shashi Prakash Singh, learned counsel for opposite parties no.3 and 4. Notice on behalf of opposite party no.2 has been accepted by Smt. P.L. Nigam. The petitioner has alleged that recognition to the petitioner's institution was granted by the National Council for Teacher Education by the order dated 13.8.2005 for B.Ed. course of one year duration for 100 seats with effect from 11.8.2005 and the University has also granted affiliation to the petitioner's institution with effect from 01.07.2005 for the academic session 2005-2006 vide letter dated 4.2.2006. Learned counsel for the petitioner submits that the Examining Committee has already taken a decision on 17.04.2009 that the students of the petitioner's institution may be allowed to appear in the examination. We, therefore, in the interest of the students direct the opposite parties no.3 and 4 to permit the B.Ed. students of the petitioner's institution provisionally to appear in the forthcoming examination for the session 2005-2006. List this petition in the month of July 2009.;
