JUDGEMENT

(1.) HEARD Sri I.B. Singh, learned counsel for the applicant and Sri Bireshwar Nath, learned counsel appearing for the Central Bureau of Investigation (C.B.I.). Gone through the contents of the F.I.R., the bail rejection order and other documents annexed along with the bail application. I have also gone through the counter and rejoinder affidavits exchanged between the parties. The matter pertains to the applicant having been challaned in Case Crime No. 557 of 2008 under Sections 489-B, 489-C, 120-B IPC of Police Station Dumariya Ganj, district Siddhartha Nagar (R.C. No. 08/08, C.B.I., EOU, New Delhi). The prosecution case against the applicant is that fake currency notes to the tune of rupees four lacs were allegedly recovered from his possession on information received from an informer about five days prior to said recovery. It is said that information was received by the Special Task Force (S.T.F.) from an informer that a person named Abid will be carrying fake currency notes on 29th July 2008 he could be found near the Mandir Chauraha within circle of police station Dumariyaganj, district Siddharthanagar. A trap was accordingly laid and the applicant was arrested and from his possession four packets of fake currency notes in the denomination of Rs. 1000/and two packets of fake currency notes in the denomination of Rs. 500/-, each packet containing 100 notes, were recovered. It is also the case of the prosecution that since all the fake currency notes recovered from the possession of the applicant, were not in serial, as such, their numbers were not noted. The accused after his arrest informed that the fake currency notes were obtained by him from one Suhail of District Gonda through one Bali Ram Misra. It is submitted by learned counsel for the applicant that after investigation having been completed by S.T.F charge sheet was submitgted, but later on investigation of the case was transferred to the C.B.I and the matter is still pending investigation. It is further submitted by learned counsel for the applicant that the applicant was lifted from his house and was roped in the present case by the personnel of the S.T.F to which there is no denial by the C.B.I. It is quite natural that the allegations so levelled against the F.T.C and its conduct cannot be answered by the C.B.I, which at present is investigating the matter. Issue notice to the Inspector General, Special Task Force and the Senior Superintendent of Police, Special Task Force to file reply with respect to the allegations levelled by the applicant against the S.T.F of lifting the applicant from his house on 29th July 2008 within three weeks from the date of receipt of this order. Learned Government Advocate shall also inform the Inspector General, Special Task Force and the Senior Superintendent of Police, Special Task Force of this order. Sri Bireshwar Nath, learned counsel for the C.B.I shall inform the Court about the latest position of investigation being made by the C.B.I. List after three weeks.;
