JUDGEMENT

(1.) THE petitioner has taken loan for business purposes and has become defaulter. THEre is no illegality in the recovery proceedings nor any error could be pointed out by the learned counsel for the petitioner. This Court would not entertain the writ petition in a matter of commercial loan, unless the recovery suffers from any legal discrepancy. However, on the request of the petitioner, liberty is given to the petitioner to approach the Bank by making a representation for repaying the loan amount, in instalments, and if such a representation is made, the same shall be considered sympathetically by the Bank without being influenced by the dismissal of the writ petition. At this juncture, learned counsel for the petitioner prays that the petitioner may be allowed to deposit the amount within six months. THE Bank may also consider the request and permit him to deposit, the amount, within the aforesaid period. On deposit of the amount under demand, the property shall be released. If the petitioner fails to deposit the amount, within the aforesaid period of six months, appropriate action for recovery may be taken against him in accordance with law.;
