JUDGEMENT
S.N.H.Zaidi, J. -
(1.) HEARD the counsel for the petitioner Sri O.P. Srivastava. When the case was taken up yesterday, none appeared for the respondents. Even today, none has appeared. The petitioner's grievance is that though he had applied for release of 314 cartons but the provisional release order related only to 219 cartons. He further says that non-release of 95 cartons is per se illegal and is a mistake committed by the authorities. On specific query being put to the counsel for the petitioner that if it is a matter of refusal to release or if there is a mistake said to have been committed by the authority in passing provisional release, how the writ petition is maintainable as all these proceedings are taken under the provisions of the relevant Act, where hierarchy of the authorities have also been provided, the learned counsel for the petitioner stated that the petition may be dismissed as withdrawn, as the petitioner would approach the appropriate forum for the relief claimed. We accordingly dismiss the writ petition as withdrawn, with liberty to the petitioner to approach the appropriate forum for release of the remaining cartons or any other relief, as may be advised, in accordance with law.;
