JUDGEMENT

(1.) HEARD Sri Anil Bhushan, learned counsel for the petitioner as well as learned Standing counsel appearing for Respondents no.1 to 3 and Sri P.N.Tripathi for the contesting respondent no.4 and have perused the record. With consent of the learned counsel for the parties, this writ petition is being disposed of at the admission stage itself. On the Manager and the Chairman of the Committee of Management having resigned, the petitioner no.2 was appointed as Manager of the institution. By an order dated 19.1.2009 passed by the Joint Director of Education, the petitioner no.2 was required to hold the elections of the Committee of Management within three months. Then by an order dated 9.3.2009 the District Inspector of Schools issued a list of members according which the elections were to be held. The submission of the learned counsel for the petitioner is that it is not the list of 21 members given in the order dated 9.3.2009 of the District Inspector of Schools, but the list of 27 members which is correct which had been published by the petitioner Committee of Management. Sri Anil Bhushan, learned counsel for the petitioner as well as Sri P.N.Tripathi, learned counsel for the contesting respondent no.4 both contend that elections have been held yesterday i.e. 19.4.2009. Both the parties claim that they have held separate elections. Learned counsel for the petitioner, however, submits that as per the order dated 19.1.2009 it was the petitioner who was to hold the elections and not the respondent no.4. Be that as it may, since the elections have already been held and there is a dispute, the matter has to be resolved by the Regional Level Committee constituted earlier on 19.12.2000 and modified by the Government order dated 20.10.2008. In the aforesaid circumstances, since the matter has to be decided by the educational authorities it would not be appropriate to pass any order in this writ petition except that the concerned Regional Level Committee shall decide the matter expeditiously after giving opportunity of hearing to the petitioner as well as respondent no.4 and other concerned parties, if there be any. With the aforesaid observation, this writ petition stands disposed of. No order as to cost.;
