JUDGEMENT

(1.) HEARD learned counsel for the applicant and learned Additional Government Advocate. Gone through the FIR, bail rejection order as well as counter affidavit filed on behalf of the State. It is a case where a Bolero Jeep was checked and it was found that the Jeep was carrying twelve containers of kerosene oil and upon number plate of the Jeep 'Bharat Sarkar' was written and, thus, the applicant has been challaned under the provisions of Essential Commodities Activities along with Sections 416, 419 and 420 IPC. Submission of learned counsel for the applicant is that the applicant was a passenger in the Jeep and has got nothing-to-do either with the kerosene oil or writing of 'Bharat Sarkar' on the number plate of the Jeep. It has been further submitted as it comes out that the driver of the Bolero Jeep has already been released on bail by the court below and co-accused Ali Mohammad has already been released on bail by this Court vide order dated 23.04.2009 passed in Criminal Misc. Case No. 2608 (B) of 2009. Taking into consideration overall aspects of the matter and without commenting any further on merit of the case and also looking to the accusation and severity of punishment, I find it a fit case for bail. Let applicant-Shyamu alias Neeraj Dwivedi, accused of Case Crime No. 253 of 2009, under Sections 416, 419 and 420 IPC read with Section 3/7 Essential Commodities Act, police station Jagdishpur, district Sultanpur be also released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of Court concerned;
