JUDGEMENT

Palok Basu, Raj Kumar Mahajan, JJ. - (1.) THE petitioner Muni Shankar Pandey is alleged to have been working as Junior Clerk in the Ayurvedic Hospital, Allahabad where it is said that huge sum of money was embezzled. Consequently, the petitioner was put under suspension and disciplinary proceedings have been initiated. Through this writ petition he has challenged the disciplinary proceedings as well as suspension order. Counter affidavit was called which has been filed to which a rejoinder affidavit has also been filed today. Sri R.P. Misra, learned counsel for the petitioner has been heard in support of this writ petition and Sri S.G. Hasnain, learned Addl. Chief Standing Counsel has been heard in opposition. As prayed, this writ petition is being finally disposed of.

IN identical matters this court has held that where the junior clerks without any drawing and disbursing powers are found to be involved, their cases should be decided expeditiously in the departmental proceedings. The allegations against the petitioner have been made the basis of a charge sheet, a copy of which has been filed as Annexure CA -1 to the counter affidavit. The entire charge -sheet was placed before the court by learned counsel for the parties. The petitioner has been put under suspension since 18.11.1996. It is a fit case where the disciplinary proceedings should be directed to be expeditiously disposed of but the suspension order need not continue any further. The writ petition consequently is partly allowed. The suspension order passed against the petitioner is set aside but the disciplinary proceedings is directed to be completed within a period of four months from today subject to constant participation and regular co -operation of the petitioner in those disciplinary proceedings.;
