JUDGEMENT
J.C.Gupta, J. -
(1.) Heard petitioner's counsel. In the circumstances of the case, this writ petition is disposed of finally, as the only grievance of the petitioner is about the delay being caused in the disposal of her case before the courts below. It appears that the petitioner filed suit for ejectment in the court of J.S.C.C., Aligarh an old lady of about 81 years of age, the defendants were causing undue delay in the disposal of the said suit. Therefore, the petitioner approached this Court by filing writ petition no. 21672/97 and the said writ petition was disposed of by the order of this Court dated 8.7.1997 with a direction to the trial court that it shall expeditiously dispose of the Suit preferably within a period of three months from the date a certified copy of this order was produced before it. It further appears trial Court ultimately decreed the suit ex parte. It further appears that after the suit was decreed some of the respondents have moved application for setting aside the ex parte decree and two of the defendants have filed revision against the ex parte decree. In the application moved for setting aside ex parte decree, the respondents are again taking adjournments.
(2.) In the peculiar circumstances of the case, the courts below are directed to dispose of application for setting aside ex parte decree expeditiously on day to day basis within a period of six weeks from the date a certified copy of this order is produced and in case of ex parte decree is set aside, the suit shall be disposed of expeditiously within a period of three months.
(3.) With the above observations, this writ petition is disposed of
