JUDGEMENT

(1.) By an order dated 11th June, 1982, the District Cane Officer, Azamgarh, appointed the petitioners No. 1, 2, 3 and 4 as Ganna Gram Sewaks on ad hoc basis. By an earlier order dated 19th May, 1982, petitioners No. 5 and 6 were similarly appointed on 19th November, 1984, a Selection Committee, July constituted, approved the appointments of the 3 petitioners before us. By a notice published in a local news - paper Deval Dainik' Azamgarh dated 18th February, 1988, the District Cane Officer, Azamgarh, has informed the public in general that the services of the petitioners and the Surendra Nath Mishra stood terminated and they should not be recognised as Ganna Gram Sewaks in future. This notice is being impugned in the present writ petition.
(2.) On 27th April, 1988, the Standing Counsel was granted six week's time to file a counter - affidavit with the direction that the matter may be listed in the third week of July, 1988. Some how or the other, the matter could not be taken up earlier, No counter - affidavit is forthcoming we are not inclined to accede to the request of the learned standing Counsel to grant any further time for filing a counter - affidavit. We are, therefore, proceeding to dispose of this writ petition finally on the assumption that the averments made in it are correct.
(3.) On 19th November, 1984, as already indicated, the appointments of the petitioners had been approved by the Selection Committee. Therefore, they acquitted a right to continue on the post until their services were terminated in accordance with law. In paragraph 14 of the writ petition it has been averred that the services of the petitioners were terminated without affording them an opportunity of hearing. This shortcoming alone, in our opinion, is enough to vitiate the order whereby the services of the petitioners have been terminated.;
