JUDGEMENT

(1.) Heard learned counsel for the petitioner, learned Standing Counsel representing the State-respondents and Sri Yogendra Nath Yadav, learned counsel for the Gram Sabha concerned.

The petitioner by means of this petition has challenged the order dated 26.09.2016 passed by the Settlement Officer, Consolidation, Lakhimpur Kheri whereby the appeal preferred by the petitioner under Section 11 (1) of U.P. Consolidation of Holdings Act preferred against the order dated 10.07.1975 passed by the Assistant Consolidation Officer in Case No.5094, has been dismissed. He has further challenged the order dated 26.07.2018 passed by the Additional Collector (Finance and Revenue)/Deputy Director of Consolidation, Lakhimpur Kheri whereby he has dismissed the revision petition preferred by the petitioner against the order dated 26.09.2016 passed by the appellate court.

The facts of the case, which do not appear to be in dispute, are that the undisputed original recorded tenure holder of the land in question was one Smt Sundra, who had executed a sale deed on 27.03.1973 in favour of one Rajjab Ali, who is the father of the petitioner. Since the village at the relevant point of time was under consolidation operation, Rajjab Ali appears to have made some prayer for getting his name recorded in the relevant records whereupon the Assistant Consolidation Officer passed an order on 10.07.1975 in Case No.5094 whereby he ordered mutation of the name of Rajjab Ali on the basis of sale deed executed on 27.03.1973 by the original tenure holder of the land in dispute Smt Sundra. The said order is not in dispute.;
