JUDGEMENT

(1.) The judgment and order dated 16.07.2015 passed by Additional District and Sessions Judge/F.T.C., Etawah in Sessions Trial Nos. 53 of 2013 arising out of Case Crime No. 98 of 2012, Police Station-Vaidpura, District-Etawah, thereby convicting and sentencing each of the appellant for 14 years imprisonment under Section 304-B IPC, one year imprisonment and a fine of Rs. 1,000/- under Section 498-A IPC and two years imprisonment and a fine of Rs. 2,000/- under Section 3/4 of D.P. Act is under challenge in the present criminal appeal.

The brief facts of the case are that the marriage of Rita Kumari(hereinafter referred to as 'deceased') was performed with the appellant no. 1-Pankaj Kumar one year before the alleged occurrence. Though, as per the capacity of the bride family, sufficient dowry was provided but the appellants were not satisfied with it and they used to harass and torture the deceased on account of it. They had also threatened the deceased that in case a motorcycle is not provided by her parents as an additional dowry, she might be killed. On 11.08.2012 at about 5:00 p.m. all the appellants jointly assaulted and thenafter set her on fire by pouring kerosene oil on her. On getting the intimation, the complainant-Kedar Nath, father of the deceased, reached on the spot and got her daughter admitted in Safai Hospital. The complaint with the said averments was handed over to the police station on 11.08.2012.

In addition to it, on 17.08.2012 another application was handed over by the complainant to the In-charge police Station-Vaidpura with the averments therein that on 11.08.2012, the appellants tried to kill the deceased by setting her on fire. The deceased, in the burnt condition, was hospitalized by the complainant for treatment but later on was transferred to Pushpanjali Hospital, Agra on 12.08.2012 for better treatment wherein she died on 13.08.2012 on account of the burn injuries received in the said incident.;
