Jayant Banerji, J. - (1.) This Special Appeal has been filed challenging the judgement and order dated 9 January 2013 passed in Writ-A No.- 987 of 2013 by means of which the petitioner's claim for honorarium for the period of 8 September 2008 to 8 December 2008 has been rejected and the petition was dismissed.
(2.) The case of the petitioner, Dhruv Chandra, is that he held the requisite qualification for the post of Shiksha Mitra. There are two post of Shiksha Mitra in Prathmik Vidyalaya Kachure, Block Bahadur Pur, District Basti. One post is held by a lady under the woman reservation quota. Applications for selection against the second post of Shiksha Mitra were invited by the Village Education Committee in the year 2005-2006. The appellant-petitioner alongwith 7 others submitted application for selection. The merit list was prepared in which the appellant-petitioner secured the highest quality points and his name was placed at serial no. 1 in the merit list.

One Parshu Ram filed Writ-A no. 29805 of 2007 challenging the selection of the appellant which was disposed of on 6 July 2007 directing the District Magistrate, Basti to decide his representation. The District Magistrate, Basti, however, rejected his representation and approved the selection of the appellant against the second post of Shiksha Mitra by order dated 30 January 2008. The appellant-petitioner joined the post of Shiksha Mitra on 8 September 2008 and continued till 8 December 2008 and performed the duties allotted to him.;
