Ram Surat Ram (Maurya), J. - (1.) Heard Sri Naresh Chandra Tripathi, for the petitioner and Sri Jitendra Narain Rai, for the respondents.
(2.) The writ petition has been filed for quashing the order of Senior Regional Manager dated 24.07.2004, terminating the petitioner from service, in disciplinary proceeding and Zonal Manager dated 10.11.2017, dismissing the appeal of the petitioner against aforesaid order.
(3.) The petitioner was appointed as a class-IV employee in Life Insurance Corporation of India on 16.05.1990. Due to unauthorized absence from duty without any information, disciplinary proceeding was initiated against the petitioner, in which charge sheet was issued against the petitioner on 10.03.2003, mentioning in it that the petitioner was absent from duty without any information during 14.11.2000 to 30.11.2000, 07.03.2001 to 17.03.2001, 26.04.2001 to 16.05.2001, 16.07.2001 to 20.08.2001 to 22.12.2001 to 13.07.2002 and from 30.10.2002 till issue of charge sheet. When he was posted at Branch Office-II of district Azamgarh, he was absent from duty without any information during 16.06.1995 to 11.07.1995, 24.09.1998 to 09.11.1998, 13.02.1999 to 21.05.1999, 07.06.1999 to 18.06.1999, 05.07.1999 to 14.01.2000. Through letters dated 30.11.2000, 16.03.2001, 08.05.2001, 03.08.2001, 01.12.2001, 04.07.2002, 16.07.2002, 07.11.2002 and 22.11.2002, explanations were called for from him in respect of aforementioned absence (total 798 days) but he did not give any reply.;
