JUDGEMENT

- (1.) This petition has been filed on 2 January 2018 to assail the notification dated 11 September 2006 that has been issued under Section 4(1)/17 of the Land Acquisition Act, 1894 'the Act' as also the declaration made on 27 October 2006 under Section 6(1)/17 of the Act. The award was also made under Section 11(1) of the Act on 30 December 2013 after taking possession of the land on 2 December 2006.

Though number of submissions have been made by learned Senior Counsel appearing for the petitioner to assail the notification under Section 4(1) of the Act as also the declaration made under Section 6(1) of the Act, but learned Standing Counsel appearing for respondent Nos. 1, 2 and 3 and Sri Kaushalendra Nath Singh, learned counsel appearing for Noida have submitted that this petition should be dismissed solely on the ground that this petition has been filed with an inordinate delay without furnishing any satisfactory explanation. Sri Kaushalendra Nath Singh learned counsel appearing for Noida has also pointed out that the petitioner had earlier filed Writ Petition No.52992 of 2016 for taking the benefit of Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 Act 'the 2013 Act' which petition was disposed of on 8 November 2016 with a direction to the State Government to decide the representation and the State Government, by a detailed order dated 9 August 2016, rejected the representation holding that possession of the land had been taken and compensation was also deposited in accordance with law. It is the submission of the learned counsel for the respondents that the petitioner has concealed the filing of the aforesaid writ petition.
