JUDGEMENT

(1.) Heard learned Counsel for the petitioners, Smt. Seema Srivastava, learned Counsel representing respondent No.1 in Land Acquisition No.4774 of 2018 and Sri Shailendra Singh Chauhan, learned Additional Chief Standing Counsel for the State-respondents.
(2.) By means of these two petitions, the petitioners have prayed for quashing the Award given by the Arbitrator under Section 3 G (5) of the National Highways Act, 1956 in relation to determination of compensation.
(3.) In our considered opinion, the petitioners ought to have filed objections invoking provisions of the Arbitration and Conciliation Act, 1996. However, learned Counsel for the petitioners has sought to argue that in view of the provisions contained in Section 63 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, the Civil Court will have no jurisdiction. He further submits that the Award has been made under the provisions of the 2013 Act and therefore, Section 63 of the 2013 Act would be applicable.;
