JUDGEMENT

(1.) This petition has been filed for a direction upon the respondents to pay fair compensation to the petitioners for the land for which they had executed sale deeds between 2006 and 2013.
(2.) It is stated that the petitioners had executed sale deeds and had received the sale consideration but the State Government has provided them lesser consideration. In this connection, learned counsel for the petitioners has pointed out that the State Government, in regard to some other land, has paid compensation as per the provisions of 'The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013' (hereinafter referred to as the '2013 Act') but the petitioners have been paid lesser consideration.
(3.) It is sought to be contended that the State Government cannot acquire land by executing a sale deed directly with the farmers instead of taking recourse to the provisions of the Land Acquisition Act, 1894 (hereinafter referred to as the '1894 Act') or the 2013 Act. The submission is that in case the State Government acquires land under the provisions of the acquisition Acts, the tenure holders have a right to claim higher compensation in accordance with the provisions of the Act but by execution of the sale deeds, the petitioners have been denied the benefit of such a procedure.;
