JUDGEMENT

- (1.) List revised. None appeared on behalf of petitioner. Heard learned Counsel for the respondents and perused the record.
(2.) The instant writ petition, under Article 226 of the Constitution of India, has been preferred with the prayer to issue a writ of certiorari quashing the impugned order dated 21.03.2012 (Annexure No.30 to the writ petition) passed by the Central Administrative Tribunal, respondent No.1 and further prayer to issue a writ of mandamus to remit the matter back to the Court below for reconsideration in the light of circular dated 5.11.2011 issued by the Railway Board and to issue any other writ, order or direction, which this Court may deem fit and proper under the circumstances of the case.
(3.) The case of the petitioner is that the petitioner was appointed in the Railway Administration as clerk Grade-II on 3.10.1978 and joined at Sonpur, which was part of N.E. Railway. He was promoted from the post of clerk Grade-II to clerk Grade-I w.e.f. 2.02.1980 considering the hard working and essential qualification for promotion. Thereafter, he was transferred from Sonpur to Gorakhpur vide order dated 7.02.1981 passed by the competent authority. He was further promoted as Section Officer vide office order dated 30.07.1983. He was transferred to Izzatnagar, Bareilly and joined on 4.08.1983. Again, he was transferred from Izzatnagar, Bareilly to Gorakpur vide office order dated 21.5.1984 and he joined as Section Officer (Accounts) on 2.06.1984 at Gorakhpur, N.E. Railway. Subsequently, he was promoted to the post of Senior Section Officer (Accounts) vide order dated 28.10.1987 and he joined the said post, but he was again promoted in Class II Services as Assistant Account Officer, and designated as Accounts Officer on 15.11.1999. Again he was promoted by the Railway Administration on the post of Divisional Accounts Officer at Varanasi and joined there on 24.11.2000. He was in service for more than 30 years without any complaint. Vide order dated 7.08.2008, he was promoted to the post of Sr. E.D.P.M and posted at E.D.P. Centre, N..E. Railway, Gorakhpur.;
