JUDGEMENT

(1.) Heard learned counsel for the petitioner and learned Standing Counsel representing the State-respondents. In view of the proposed order, the requirement of issuance of notice to the respondent No. 4 is hereby dispensed with.

The petitioner in these proceedings instituted under Article 226 of the Constitution of India has challenged the order dated 23.01.2018, passed by the Additional Commissioner (Judicial), Lucknow Division, Lucknow in a revision petition filed by the respondent No.4 against an order dated 27.04.2017, whereby the lease in respect of fishing rights relating to the pond/tank was approved in favour of respondent No.4.
(3.) Submission of learned counsel for the petitioner is that after U.P. Revenue Code, 2006 has been enforced, no revision under Section 333 of U.P. Zamindari Abolition and Land Reforms Act, 1950 (herein after referred to as "U.P. Z.A. and L.R. Act") is maintainable before the Commissioner against the order approving the lease in respect of fishing rights for the reason that Rule 59 of the U.P. Revenue Code Rules, 2016 provides remedy of appeal before the Collector in such matters. He has also stated that he has moved an application seeking vacation of the order dated 23.01.2018 raising the plea of non-maintainability of the revision petition filed by the respondent No.4.;
