JUDGEMENT

(1.) These three writ petitions have been filed by the Institutions existing in District Meerut seeking affiliation. The claim of the petitioners in the said writ petitions was that they had applied in time for grant of affiliation but their applications were not processed at the ends of Principal DIET, Meerut. As a result of his reckless attitude, the petitioners suffered financial loss as they were deprived of running the course.
(2.) In order to ascertain the submissions of the petitioners, the Principal DIET Meerut was directed to file his personal affidavit explaining the circumstances in which the delay had caused.
(3.) Same stand has been taken in three separate affidavits filed by Principal DIET in the writ petitions. It is contended therein that the Institution was required to inspected by the Principal, DIET on 19.4.2017 but one of the inspection panel constituted by the Joint Director of Education was not available. There were 20 files of new Institutions which were seeking affiliation for the academic session 2017-18. It was not possible for Principal DIET, Meerut to process all the files within two days. The inspection report alongwith the applications were forwarded to the Office of Secretary, Examination Regulatory Authority on 29.5.2017. Thus, it is admitted that applications alongwith the inspection panel were forwarded by the Principal DIET, Meerut a day before the last date fixed for grant of affiliation by the Apex Court in the case of Maa Vaishno Devi Mahila Mahavidyalaya Vs. State of U.P., 2013 2 SCC 617.;
