JUDGEMENT

(1.) Heard Sri V.C. Mishra, learned Senior Advocate, assisted by Sri Ghan Shyam, learned counsel for the appellant and Sri Prateek Sinha, learned Brief Holder, appearing for the State respondents.

Learned Single Judge, by the order under challenge, dismissed the writ petition filed by the petitioner, challenging the notice of the District Magistrate, Farrukhabad dated 15.02.2018 whereby open general meeting of the Gaon Sabha was to be held for consideration of as to whether the working of the late husband of the appellant who was the erstwhile fair price shop dealer were satisfactory and his reputation was good so that the licence may be transferred in the name of the appellant or else fresh selection exercise be carried out recommending names for allotment of the license of fair price shop dealer of the village in question. From the record we find that three meetings have been held, in the meantime, and in two meetings, favourable report was given supporting the claim of the appellant for transfer of the fair price dealer license in her name. However in the third meeting no decision could be taken as the quorum was not complete.

The grievance of the appellant is that the repeated holding of open general meetings of the Gaon Sabha is not warranted and in view of the first meeting held, the license ought to have been settled in favour of the appellant. From the record we also find that there is a strong discord between the appellant side and the stand taken by the Pradhan of the Village and his supporters who opposed to the settlement of the license in favour of the appellant. The Officers holding the meetings had requested for sufficient police force to ensure that peaceful meeting is held.;
