JUDGEMENT

- (1.) Heard learned counsel for the petitioner and learned counsel for the respondents. This petition has been filed with the following prayers: "1. issue a writ, order or direction in the nature of Certiorari quashing the impugned dismissal order dated 28.11.2017 passed by the Member Secretary/Cadre Authority, Cooperative Bank Centralized Service, U.P. Cooperative Ltd., 2-M.G. Marg, Lucknow (the opposite party no.2) contained herewith this writ petition as annexure no.1. 2. issue a writ, order or direction in the nature of Certiorari quashing entire departmental proceedings conducted against the petitioner in total unfair and arbitrary manner and further this Hon'ble Court may be pleased to quash the charge sheet contained herewith as annexure no.3 as has been made basis of dismissal order passed by the opposite party no.2. 3. issue a writ, order or direction in the nature of Mandamus commanding the opposite parties to pay entire retiral benefits of the petitioner such as gratuity, leave encashment, group insurance and the provident fund etc. as well as arrears of salary unpaid for the month of June, 2016 and for the period July, 2017 pending disposal of this writ petition."
(2.) Learned counsel for the petitioner submits that against the impugned order, the petitioner has preferred an appeal, which has not been disposed of up till now. He, therefore, prays that the authority concerned may be directed to decide the appeal preferred by the petitioner, as the petitioner is suffering on account of non-disposal of the said appeal.
(3.) Accordingly, the writ petition is disposed of with the direction that the appellant authority shall consider and dispose of the appeal preferred by the petitioner, in accordance with law within a period of two months from the date of receipt of a certified copy of this order.;
