Neeraj Tiwari, J. - (1.) Present Special Appeal arises out of a judgment and order dated 19 February 2015 by which a learned Judge of this Court has dismissed the writ petition filed by the appellant. The prayer made in the writ petition was to quash the order dated 13 September 2011 and further command the respondents to consider the claim of the petitioner for the post of Mukhya Sevika pursuant to the Government Order dated 25 July 2006.
(2.) The appellant was appointed as Anganwadi Karyakatri on 11 January 1983 in the office of Bal Vikas Pariyojana Adhikari, Birno, Ghazipur and was working continuously since the last 27 years. The State Government amended the Uttar Pradesh Bal Vikas Evam Pushtahar (Adhinasth) Seva Niyamawali, 2006 (in short, the "Rules, 2006") on 25 July 2006. This provides that Anganwadi Karyakatri, who have completed 10 years of continuous service from the date of recruitment and have not completed the age of 50 years may be considered by Selection Committee for appointment on the post of Mukhya Sevika. Proceeding for selection on the post of Mukhya Sevika started and finally a list was prepared from those Anganwadi Karykari, who had completed 10 years of continuous service for the selection on the post of Mukhya Sevika. The name of appellant was placed at serial No. 28 in the said list.

A letter dated 4 September 2009 was also sent to District Programme Officer, Ghazipur to inform the concerned Anganwadi Karyakatri to appear before Directorate of Bal Vikas Sewa Evam Pushtahar, U.P., Lucknow along with certain documents and pursuance thereof, Bal Vikas Pariyojna Adhikari, Ghazipur issued a letter dated 15 September 2009 to the appellant directing her to appear before the Directorate of Bal Vikas Sewa Evam Pushtahar, U.P., Lucknow on 18 September 2009 at 10:00 am.;
