JUDGEMENT

- (1.) Heard Mr. Rakesh Kumar Singh, learned Counsel for the petitioner, Mr. Ashok Shukla, learned Counsel for the U.P. Public Service Commission and learned Standing Counsel.
(2.) The petitioner has approached this Court under Article 226 of the Constitution of India, challenging the letter of the Principal Secretary, Irrigation Department, Lucknow dated 17.11.2013 sent to the Secretary, Public Service Commission, Allahabad, whereby a requisition was sent to the U.P. Public Service Commission, Allahabad for selection on the post of Assistant Engineer (Civil) relating to the vacancies of the years 2013-14, 2014-15 and 2015-16 of the Irrigation Department. The petitioner has also challenged the requisitions sent by the other department such as Public Works Department, Minor Irrigation Department of the vacancies of the years 2013-14, 2014-15 and 2015-16.
(3.) According to the petitioner, in the year 2015, he obtained the qualification of B. Tech degree from the Institution of Engineering and Technology, Sitapur Road, Lucknow in Civil Trade. Vide letter dated 7.11.2013, the Principal Secretary, Irrigation Department, Lucknow, sent a requisition to the Public Service Commission for starting process of selection for the vacancies of Assistant Engineers in all other departments including the Irrigation Department of the years 2013-14, 2014-15 and 2015-2016. Pursuant to the letter dated 7.11.2013, the Public Works Department published an advertisement for the post of Assistant Engineer as Combined State Engineering Services (General Recruitment) Examination, 2013 (back-log)/Special Recruitment Examination, 2013. In the said advertisement, the last date of submitting the application forms was 24.1.2014 and the vacancies calculating upto the year 2016 would be total 640.;
