The writ petition has been filed for quashing the orders of Principal Secretary, Govt. of U.P., dated 24.06.2015, rescinding guidelines given in Circular dated 26.05.2015, issued by Secretary, U.P. Secondary Education Service Selection Board, Administrator/Additional District Magistrate (F&R) dated 24.07.2017, rejecting the representation of the petitioner, for giving her adhoc promotion on the post of Principal and Joint Director of Education, dated 29.05.2017, setting aside his earlier order dated 16.05.2017.
(3.) The petitioner was appointed as 'Subject Expert', by the order of Joint Director of Education dated 16.06.2001, in Arya Kanya Inter College, Saharanpur. For working as 'Subject Expert', she was getting honorarium of Rs. 5000/- per month and working period was for 11 month in a academic session. By U.P. Act No. 37 of 2006, Section 21-E was added in U.P. Secondary Education Services Selection Board Act, 1982 (hereinafter referred to as the Act), requiring to absorb the 'Subject Expert' working in private aided secondary schools, on 30.09.2006 for minimum period of at least two academic session, possessing prescribed educational and training qualification, towards permanent vacancies in the aided colleges. In Nagar Palika, Kanya Inter College, Muzaffar Nagar, a permanent vacancy of the post of 'Lecturer, Political Science' arose, on 30.06.2007, due to retirement. In view of Section 21-E of the Act, Director of Education (Secondary), by letter dated 05.09.2007 directed District Inspector of School, Muzaffar Nagar to absorb the petitioner at that post. District Inspector of School, Muzaffar Nagar, through his letter dated 26.09.2007, directed the Management of Nagar Palika Kanya Inter College, Muzaffar Nagar to appoint the petitioner on the post of 'Lecturer, Political Science'. In pursuance thereof, the petitioner was appointed and she joined as 'Lecturer, Political Science' in Nagar Palika Kanya Inter College, Muzaffar Nagar on 13.11.2007. Since then she is continuously working.;
