(1.) This Special Appeal has been filed against the judgment and order dated 24 January 2018, passed in Writ-A
(2.) No. 2368 of 2015, whereby, the learned Judge has rejected the claim of the petitioner-appellant for compassionate appointment after 13 years of death of his father in 2005 and, accordingly, dismissed the writ petition.
(3.) It was alleged in the writ petition that the father of the petitioner-appellant was appointed on the post of ASI(M) in the U.P. Police Department and he was posted in the office of the Senior Superintendent of Police, Saharanpur (hereinafter referred to as S.S.P.) and he died on 1 February 2005 during his service tenure. On the death of the father of the petitioner-appellant, he moved an application for appointment on compassionate ground and the SSP issued a letter on 7 February 2013 directing the petitioner-appellant to appear for shorthand and typing test on 23 February 2013. The petitioner-appellant's application for appointment was rejected on the ground that he could not qualify the test and was directed to apply for another post. Thereafter, the petitioner-appellant submitted another application on 26 October 2013 and the SSP by his letter dated 6 June 2014 informed the petitioner-appellant that for compassionate appointment, he can apply for class IV post. This letter of the SSP was the subject of a writ petition filed by the petitioner-appellant in Writ Petition No. 39997 of 2014 which was disposed of by order of the Court dated 4 August 2014 directing the Deputy Inspector General of Police, Headquarter to consider the claim of the petitioner-appellant for his appointment on the post of ASI (M) in accordance with law. Pursuant to the said order, by order dated 27 November 2014 the representation of the petitioner-appellant was disposed of with a direction that in case the petitioner-appellant desires service of class IV post, he may move an appropriate application. Thus, the order dated 27 November 2014 was challenged in the writ petition.;
