JUDGEMENT

(1.) The dismissal of writ petition filed by the appellant with a prayer that the respondents should take a decision on the application dated 6 April 2017 filed by the appellant seeking appointment on compassionate ground on any group 'D' post has led to the filing of this Special Appeal under Chapter VIII Rule 5 of the Allahabad High Court Rules.
(2.) It transpires that the father of the appellant, who was working as a Cobbler in the Border Security Force, died in harness on 8 September 1991. The appellant was then a minor aged about one year. He, however, moved an application seeking appointment on compassionate grounds as a Constable in Border Security Force. This application was rejected for the reason that the appellant did not satisfy the height requirements. The appellant filed a Special Appeal but did not press it for the reason that the appellant intended to approach the concerned authority once again for appointment on compassionate ground on a Group 'D' post. The appellant thereafter filed an application on 6 April 2017 seeking compassionate appointment and when no decision was taken, he filed Writ-A No.62454 of 2017 which was dismissed on 9 January 2018 for the reason that the application was filed belatedly.
(3.) It is not in dispute that the father of the appellant had died way back on 6 September 1991. The appellant had submitted an application on 20 October 2008 for appointment as a Constable and it is after the rejection of the said application on 3 August 2012 that the petitioner filed Writ-A No.4831 of 2017 that was dismissed on 10 February 2017. Thereafter the appellant filed the application on 6 April 2017 and Writ-A No.62454 of 2017, out of which this Special Appeal arises, was dismissed.;
