Jayant Banerji, J. - (1.) The Special Appeal has been filed against the judgement and order dated 18 October 2012 passed in Writ-C No. 55497 of 2012 whereby the Learned Judge has quashed the order dated 24 September 2012 passed by the Assistant Registrar, Firms Societies and Chits, U.P. Allahabad1 granting renewal of registration; the communication dated 9 October 2012; and the order dated 10 October 2012 passed by the Assistant Registrar rejecting the objections that has been filed.

The petitioners/first set of respondents/respondent nos. 1, 2, and 32 had filed the writ petition in which it was stated that the Anglo Sanskrit College and Kunwar Chandra Bhukhan Singh Anglo Sanskrit High School Committee, Fatehpur (hereinafter referred to as the 'first Society') is registered society under the Societies Registration Act, 18603. This first Society was duly registered for the first time by order dated 11 June 1953 and the last renewal certificate of the Society was granted on 18 October 2010 which was effective from 10 October 2010 to 10 October 2015. The Bye laws of the first Society proposed to establish High School, Inter College and Degree College. It was stated that the first Society is running three colleges including a degree college. The first Society also established a degree college known as Anglo Sanskrit Degree College in the year 1961 which was renamed as Mahatma Gandhi Degree College and the same was duly recognized by the Agra University, Agra.
(3.) On 28 February 1966 the degree college was granted permanent recognition by the Agra University. The said degree college was then affiliated to the Chhatrapati Sahu Ji Maharaj University, Kanpur. It was alleged that a few persons who were working in the first Society in the year 1965, fabricated documents and got another society registered in the same name as Anglo Sanskrit College and Kunwar Chandra Bhukhan Singh Anglo Sanskrit High School Committee, Fatehpur (hereinafter referred to as the 'second Society') and a registration certificate dated 17 November 1965 was issued. When this fact of registration of the second Society came to the knowledge of the members of the first Society, objections were raised and as a result, the registration of the second Society was not renewed after 1995. The Committee of Management of the initial Society was also granted recognition by the Vice Chancellor of the University by means of the order dated 14 December 2007. Fresh elections to the Committee of Management of the first Society was held on 2 January 2012 and approval of the same by the Vice-Chancellor of the University was awaited.;
