JUDGEMENT

(1.) Heard learned counsel for the petitioner and Sri Rajneesh Kumar Srivastava, learned counsel for respondents no. 2 & 3.
(2.) In compliance of the order dated 8.01.2018 Sri Jitendra Kumar Singh, Branch Manager of Punjab National Bank, Branch Iglas, district Aligarh is present in person. He has stated that there is a total sum of Rs.1,05,64,930/- outstanding in the cash credit account, which was obtained by the husband of the petitioner. Unfortunately, he was kidnapped and till date his whereabouts is not known.

Petitioner, wife of the borrower states that in case she is permitted to deposit the outstanding loan amount in instalments, he will clear the same within a reasonable time which was allowed by this Court. Considering the facts that the bank will be able to realise the entire outstanding loan amount and the mortgaged property of the petitioner would also be saved and with the consent of the learned counsel for the parties, we permit the petitioner to deposit the entire outstanding amount in four equal instalments. The first instalment shall be deposited by 31 March, 2018, second instalment by July, 2018, third instalment by November, 2018 and the last instalment by 31 March, 2019. It is further provided that after deposit of third instalment, the bank shall issue a statement of account to the petitioner calculating the interest which has to be accrued during the said period and shall also accrue till deposit of fourth instalment, which shall be deposited by the petitioner along with last instalment.;
