JUDGEMENT

(1.) Heard Mr. Dinesh Kumar Maurya, learned counsel for the petitioner and Sri Devendra Arora, learned counsel for opposite parties 1 and 2. With the consent of learned counsel for the parties, the writ petition is being disposed of at the admission stage itself. It has been stated that the petitioner appeared in B. A. II Year Examination, 2008 conducted by Dr. Ram Manohar Lohia University, Faizabad as private student from B. B. C. Public Degree College, Barna, Lalgopalganj, Kunda, Pratapgarh. When the result of the aforementioned examination was declared, the petitioner shocked to know that she declared successful but the marks, which have been awarded in Political Science I and II papers, were not her expectation. Hence the instant writ petition has been preferred by the petitioner. At this stage, learned counsel for the University has submitted that there is no provision for re- evaluation of the marks. However, in case the petitioner moves an application for scrutiny of the aforesaid papers in accordance with Rules, the University will consider the same sympathetically, to which, learned counsel for the petitioner has submitted that he does not want to press the instant writ petition but restricts his prayer only to the extent that the petitioner may be allowed to move an application for scrutiny of the aforesaid papers and the University may be directed to dispose of the same, expeditiously. Under the circumstances, without entering into the merit of the case, it is provided that in case the petitioner moves an application for scrutiny of the aforesaid papers in accordance with Rules within a week from the date of receipt of a certified copy of this order, the University is directed to dispose of the same, expeditiously, say, by 20. 2. 2009. With these directions, the writ petition stands disposed of finally. .;
