JUDGEMENT

(1.) B. A. Zaidi, J. This is an application for transfer of cross cases (Sessions Trial Nos. 125/2001, 127/2001 under sections 147, 148, 149 and 307 Indian Penal Code) pending in the Court of Additional Sessions Judge/f. T. C. /court No. X, Mathura. The District Judge had earlier rejected the request of transfer.
(2.) I have heard Counsel for the parties and Sri Mohammad Israil Siddiqui, Addl. Government Advocate for the State.
The contention of the applicant is that a person named Rajesh contacted him and told him that if he is willing to pay Rs. Two Hundred Thousand, the case against him can be decided in his favour and he can be acquitted. It is further said that he expressed his inability to make such payment, and that is why, he apprehends that justice will not be done.
A circumstance highlighted by the Counsel for the applicant, in his support was that, on 4. 1. 2008 on which date case was fixed for judgment, only one out of six of the opposite-party appeared in Court, which demonstrates their confidence about being acquitted.
(3.) IN view of circumstances appearing in the case, it seems desirable that the cases should be shifted from this Court, so that the parties may not harbour any apprehension.
We, therefore, feel inclined to transfer the cases which will, therefore, go to the Court of District and Sessions Judge for further proceedings according to law.;
