JUDGEMENT
DEVI Prasad Singh, Satish Chandra, JJ. -
(1.) Heard Mr. I. P. Singh, learned counsel appearing for the petitioner and Mr. Ram Raj, learned counsel for the respondents. Learned counsel for the petitioner submits that the petitioner possesses a bank draft of Rs. 50 lacs which he could not submit in terms of the order dated 14. 10. 2008. He wants extension of time. Accordingly, we permit the petitioner to deposit the remaining amount of Rs. 50 lacs before 10. 12. 2008. The petitioner shall deposit another sum of Rs. 50 lacs to the Meerut Development Authority on or before January 10, 2009. It has been submitted by the petitioner's counsel that while claiming the development charges for the land in question, Meerut Development Authority has not discharged its obligations with regard to external development. The District Judge, Meerut is directed to send as early as possible in the month of December, 2008 itself an officer of his Judgeship along with other necessary staff to inspect the area in question with regard to external development and submit a report to this Court by the next date of listing. While making spot inspection, the District Judge may permit the learned counsel for the parties to be present at the time of inspection. The cost of the Commission which is assessed to Rs. 5000/- and shall be at the disposal of the District Judge shall be borne by the petitioner who shall deposit the same within three days. Subject to the aforesaid direction and deposit of Rs. 50 lacs by the petitioner, the interim order dated 24. 10. 2008 shall continue. List in the last week of January, 2009. The writ petition may be finally disposed of on the next date. The petitioner shall serve a certified copy of this order to the learned District Judge, Meerut within 10 days from today. .;
