(2.) HEARD learned Counsel for the applicants and learned A. G. A. No one is present for the opposite party No. 2. It is a matrimonial dispute. The matter was referred to Mediation and Re conciliation Centre. As per the report of the Mediation and Re-conciliation Centre dated 13. 5. 2008 parties have entered into compromise and signed settlement of agreement on 13. 5. 2008.
The marriage of applicant No. 1 was solemnized with the daughter of op posite party No. 2 on 6. 5. 2005. The first in formation report was lodged by the oppo site party No. 2 which was registered as case Crime No. 405/2007, under sections 498-A, 323, 504, 506 I. P. C. and 3/4 Dowry Prohibition Act, P. S. Delhi Gate, District Aligarh. The applicant No. 1 is a registered B. A. M. S. Doctor and practicing at Agra, applicant No. 2 a Joint Commissioner, Trade Tax and applicant No. 3 is mother of the applicant No. 1.
Since, the parties have entered into compromise, it would not be fruitful to continue the prosecution and in the interest of justice, application is allowed. The entire proceedings of case No. 10872/2007 includ ing charge-sheet No. 162/2007 arising out of case Crime No. 405/2007, under section 498-A, 313, 323, 504, 506 I. P. C. and 3/4 Dowry Prohibition Act, P. S. Delhi Gate, District Aligarh pending in the Court of Chief Judicial Magistrate, Aligarh is hereby quashed in terms of the settlement of agreement signed by the parties before the Mediator of the Mediation and Re conciliation Centre on 13. 5. 2008. Application Allowed. .;
