JUDGEMENT
PRADEEP Kant, Shabihul Hasnain, JJ. -
(1.) Heard the learned counsel for the petitioner Sri Anurag Verma, Sri Navneet Agarwal for the State, Sri D. K. Arora for the Chancellor and Sri Shashi Prakash Singh for the University. With the consent of the parties' counsel, the petition is being disposed of finally at the admission stage. The petitioner-institution is duly recognized by the NCTE and affiliation has also been granted with respect to 200 intakes of B. Ed. students. The petitioner's case is that in the counselling earlier held, only 165 students have been provided, whereas there remains 35 seats still vacant. The submission is that the special counselling is to take place in pursuance of the High Court's order passed in Writ Petition No. 59113 (MS) of 2008, decided on 20. 11. 2008 and, therefore, the petitioner- institution is also entitled to participate in the said counselling, as the respondents say that the said counselling is being held only in pursuance of the High Court's order. We, under the circumstances, feel that in case the petitioner-institution is duly recognized by the NCTE and affiliation has also been granted for 200 intakes in B. Ed. Course, they may be allowed to participate in the counselling, which is scheduled to be held on some future date and the students be also provided accordingly. The writ petition is disposed of accordingly. .;
