JUDGEMENT

(1.) The petitioner is aggrieved by an order dated 14-4-87 passed by the IInd Addl. Civil Judge, Kanpur/Prescribed Authority, Kanpur Nagar allowing the respondent's Landlord to file certain documents at the time of arguments of the case.
(2.) I have heard Mrs. Poonam Srivastava, learned counsel for the petitioner. She contended that the respondent landlord in order to fill up the lacuna in the case, wanted to file certain documents at the time of arguments, which he could file earlier and as such Court committed an error in allowing the respondent landlord to file those documents. The impugned order is purely interlocutory in nature. The case has not been disposed of on merits so far and as such I am not inclined to interfere under Article 226 of the Constitution of India. The petition is accordingly rejected.
(3.) However, after the documents which the respondent-landlord wants to file are filed, the petitioner shall be afforded an opportunity to rebut those documents and in case, the case is decided against the petitioner, it shall be open to the petitioner to agitate this point in further proceedings. A copy of this order may be given to the learned counsel for the petitioner on payment of usual charges within forty eight hours. Petition decided accordingly.;
