JUDGEMENT

(1.) The seven petitioners before us are aggrieved by identical but different communications sent to them by the Secretary/General Manager of the Zila Sahkari Bank, respondent No. 1 stating therein that instead of their being paid salary on regular basis the payment will be made to them on daily basis.
(2.) Sri Negi appears for the respondent No. 1. The respondent No. 2 has been duly served under our orders. A counter-Affidavit has been filed on behalf of the respondent No. 1. The petition is, therefore, ripe up for hearing. Though not formally admitted it is being disposed of finally.
(3.) Sri Negi has not been able to defend the impugned communications and in our opinion very rightly. We see no justification as to why the petitioners, who have been paid hitherto on regular basis, should be switched over to daily basis. The principle of law is now well settled that there is an obligation on the (sic) and its instrumentality to give equal pay for equal work. There is abundant material on record to the effect that several persons are still being paid on regular basis. The impugned communications are, therefore, liable to be struck down on this short ground.;
