Devendra Kumar Upadhyaya, J. - (1.) Since the order under challenge in both these petitions is the same, that is the order dated 08.08.2016 passed by the District Basic Education Officer, Sultanpur, these petitions are being disposed of by the common judgement and order which follows as under.

Heard Dr. L.P.Misra, learned counsel appearing for the petitioner-Om Prakash Mishra (in writ petition no.20209 (S/S) of 2016), learned Standing Counsel appearing for State-respondents, Sri J.B.S. Rathour, learned counsel appearing for District Basic Education Officer, Sultanpur, Sri R.K.Singh-II, learned counsel representing Committee of Management of the institution, namely, Shri Patti Devi Uchchatar Madhyamik Vidyalaya, Bilwayee, Sultanpur and Sri H.G.S.Parihar, Senior Advocate assisted by Sri P.K.Singh Vats, learned counsel representing respondent no.9-Satish Chandra Dwivedi (in writ petition No.20209 (S/S) of 2016).

Under challenge in these petitions is an order dated 08.08.2016 passed by District Basic Education Officer, Sultanpur whereby the appointment of Om Prakash Mishra against the post of Clerk in the institution has been disapproved and directions have been issued to the Committee of Management to appoint Satish Chandra Dwivedi against the said post on compassionate grounds in the institution.;
