JUDGEMENT
Anil Kumar, J. -
(1.) Heard Sri Ashwani Kumar, learned counsel for petitioner, learned State counsel and perused the record.
(2.) Learned counsel for petitioner submits that the petitioners are the resident of Gonda and he belongs to Gond caste, Hindu religion. On 15.01.2009, petitioner after completing his MBBS from King George's Medical College (KGMC) was admitted in Master of Surgery (Orthopaedics) in Lal Lajpat Rai Memorial Medical College, Meerut and submitted his caste certificate issued by competent authority bearing No. 53208400339 that he is a member of schedule caste as his sub-caste Dhuriya Gond and this caste is already mentioned in the Notification issued by the Secretary, Government of India on 12.08.1969 in which the sub-castes, such as, Dhuriya, Nayak, Ojha, Pathari and Raj-Gond were mentioned as sub-tribes of tribe Gond.
(3.) However, some persons who have got enmity with the petitioner submitted a complaint that petitioner does not belong to Gond (Dhuriya) i.e. schedule caste category but belongs to another caste. Accordingly, the caste certificate of the petitioner was sent for verification to the Tehsil authorities and while doing verification, the Lekhpal and Tehsildar have made illegal demand, as the petitioner did not succumb to their illegal demand, they submitted false report.;
