JUDGEMENT

Mahesh Chandra Tripathi, J. - (1.) Jawahar Singh alias Ram Babu is before this Court assailing the order dated 12.4.2016 passed by the Civil Judge (Junior Division)/Fast Track Court, Mathura in Original Suit No.239 of 2006 (Subhash Chand vs. Jawahar) whereby he has decided the issue Nos. 4 and 5 regarding valuation of the suit and the payment of court fee in favour of the plaintiff and the order dated 15.7.2017 passed by the Additional District Judge/Special Judge, Mathura in Civil Revision No.150/2016 (Jawahar @ Rambabu vs. Subhas Chaturvedi and others) by which he has dismissed the Civil Revision in question and affirmed the order dated 12.4.2016.

Record in question reflects that the plaintiff-respondent no.1 has filed a Suit No.239 of 2006 (Subhash Chaturvedi vs. Jawahar Singh) before the Court of Civil Judge (Junior Division), Mathura for permanent injunction. In the aforesaid suit, the petitioner-defendant no.1 raised an objection stating that the valuation of the suit property was undervalued and insufficient court fees was paid. In the aforesaid suit, the issue nos. 4 and 5 were framed regarding valuation of the property in question and the court fees. On 12.4.2016 the court below had decided the issue nos. 4 and 5 in favour of plaintiff-respondent no.1. The petitioner filed the Civil Revision No.150 of 2016 assailing the order dated 12.4.2016. By the impugned order dated 15.7.2017 the Additional District Judge/Special Judge, Mathura has dismissed the Civil Revision in question.
(3.) Learned counsel for the petitioner could not point out any manifest error apparent on the face of record in the impugned orders so as to justify interference by this Court in extra ordinary jurisdiction under Article 227 of the Constitution of India.;
