JUDGEMENT
B. Amit Sthalekar, J. -
(1.) Heard Sri Alok Kumar Yadav, learned counsel for the four petitioners and Sri Vikram Bahadur Yadav, learned Standing Counsel for the State-Respondents.

The petitioners are seeking quashing of the order dated 24/27.12.2014 whereby their claim for regularization of their services has been rejected on the ground that in the Policy of 21.08.2007 the period of three years had been prescribed for the validity of the said Policy and since 3 years had already passed the claim of the petitioners cannot be considered.
(3.) Briefly stated the undisputed facts of the case are that the petitioners were engaged in the Census Department from 02.08.2000 to 31.05.2001. The letter of appointment of the petitioners mentions that their appointment was purely temporary. In the meantime a Writ Petition No.12171 of 2002 (Subodh Kumar Kaushik Vs. State of U.P. and others) was filed by petitioners therein seeking regularization. That writ petition was disposed of by the learned Single Judge by the judgment dated 07.10.2005, copy of which has been filed as Annexure-15 to the writ petition, with a direction to the State Government to frame a Scheme for absorption of employees appointed in the Census Operations in the light of the observations made therein and also in the light of the judgment given by the Supreme Court. Paragraphs 12, 13 and 14 of the judgment read as under:
"12. In view of the aforesaid, the impugned order does not suffer from any error of law. At the present moment, no mandamus can be issued to the respondents to absorb the petitioner in the Government employment. However, a direction is issued to the State Government to frame a scheme to absorb the employees appointed in the Census operations within six months and consider the case of the petitioner and other similarly situated persons.
13. Writ Petition is disposed of with the aforesaid directions.
14. A certified copy of this order shall be filed by the petitioner before the District Magistrate, Jhansi, who will forward it to the relevant department of the State Government for framing the scheme in the light of the observations made above and also as per the directions of the Supreme Court in the case of Government of Tamil Nadu & Anr. v. G. Ammeenudeen & Ors..";
