JUDGEMENT

(1.) Heard Sri D.S.P. Singh, learned counsel for the petitioner and Sri Mahboob Ahmad, Sri Vikas Budhwar, learned counsel appearing for the respondent oil companies as well as Sri G.N. Kanaujia, learned counsel appearing for the respondent Nos. 1 and 2.
(2.) This writ petition has been preferred seeking quashing of an advertisement dated 27 December 2016 issued by the fourth, fifth and sixth respondents oil distribution companies. The challenge to the advertisement is confined to locations specified at serial Nos. 303 and 612 and relates to an invitation of applications for grant of LPG distributorship.

The challenge is based on the ground that the petitioner was granted a distributorship by the Indian Oil Corporation Ltd. whose terms clearly provided that the petitioner would act as a distributor within a 15 Kms. radius of the town limits of Dhaurahara. It is submitted that the proposed locations for which applications have been invited by the respondents is within 4 Kms. of the location of the dealership of the petitioner. The second ground of challenge is based upon the provisions of clause 2.4.1.1.1 of the Unified Guidelines For Selection Of LPG Distributorship 2016 on the strength of which the learned counsel for the petitioner contends that his distributorship is not liable to be restructured since it has yet to achieve or breach the ceiling limit of 8800 refills per month.;
