JUDGEMENT

(1.) Heard Sri Prafull Kumar Yadav, learned Standing Counsel for the State/petitioners, Sri Rajeev Singh, learned counsel representing the claimant/respondents-Ghanendra Singh and perused the record.

By means of present writ petition the petitioners have challenged the judgment and order dated 23.07.2014 passed by the State Public Services Tribunal, Indira Bhawan, Lucknow in Claim Petition No.188 of 2011 (Ghanendra Singh Vs. State of U.P. and others), by which the claim petition has been allowed.
(3.) Facts of the present case, in brief, are that on 07.06.2006, respondent No.1/Ghanendra Singh has been recruited as Police Constable No.630 in Civil Police, U.P. After recruitment it was mandatory to file affidavit regarding certain information to the effect that candidates have never involved in any criminal activities and in this regard the claimant/Ghanendra Singh has filed an affidavit to the effect that there is no criminal case pending against him. Subsequently, Superintendent of Police, Shahjahanpur has been received an information that the petitioner has filed an affidavit at the time of recruitment that no criminal case is pending against him, rather against the petitioner an F.I.R. under Section 420, 323, 504, 506 and 376 I.P.C. has been lodged and in the said matter the criminal case is under consideration before the Court of ACJM, Anoop Shahr, Bulandshahr (Case Crime No.C-12 of 2006). In view of the said fact, by order dated 20.09.2007 the Superintendent of Police, Shahjahanpur has cancelled the petitioner's appointment from the post of Police Constable, challenged by the petitioner by filing appeal, rejected by order dated 18.12.2010 passed by the Appellate Authority/Inspector General of Police, Bareilly Range, Bareilly, U.P.;
