JUDGEMENT

(1.) Heard Sri Siddarth Nandan, learned Counsel for the petitioners and, Sri T.J.S. Makker, learned counsel for the respondent Nos.3 and 5, learned Standing Counsel for the respondent Nos.2 and 4 and Sri Shashi Prakash Singh for the respondent No.1.

All these writ petitions have come up contending that a Certiorari be issued to quash the order impugned dated 28.2.2017 whereby a decision has been taken by the respondents to invite fresh tenders in respect of works that are to be carried out in the districts of Gonda, Pratapgarh and Amethi. The main stand of the petitioners is that the respondents have proceeded to accept tenders at some places and have discriminated the petitioners by refusing to proceed with the tender process in spite of the fact that the petitioners are the lowest tenderers on grounds which are absolutely irrational and therefore violates Article 14 of the Constitution of India.
(3.) Learned Counsel for the petitioners submits that there is no valid reason for re-inviting tenders and the caption given in the impugned order for re-inviting the tenders as there were uncompetitive bids is against the evidence on record. It is further submitted that all the petitioners were successful bidders and having offered lowest rates were entitled to be considered for the award of the work, but the respondents have proceeded to discriminate the petitioners for no valid reason, when at the same time they have chosen to award certain contracts in respect of certain other works on a similar pattern without re-inviting tenders.;
