The present application under Section 482 Cr.P.C. has been filed on behalf of the applicants to quash the entire proceeding as well as summoning order dated 3.7.2012 passed by Additional Chief Judicial Magistrate, Court no. 6, Ghaziabad in complaint Case No. 6714 of 2011, (Sandeep Pal Vs. Anupriya and others), P.S. Murad Nagar, District Ghaziabad pending in the court of Additional Chief Judicial Magistrate, Court no. 6, Ghaziabad,
(2.) Heard learned counsel for the applicants, learned counsel for the opposite party no. 2 as well as learned A.G.A. for the State and perused the record.
(3.) Learned counsel for the applicants submits that the marriage of applicant no. 1 Anupriya Pal was solemnized with opposite party no. 2 Sandeep Pal in the year 2007. The opposite party no. 2 and his family members harassed and tortured to the applicant no.1. In this regard, the applicant no. 1 has filed a complaint under the Protection of Women from Domestic Violence Act, 2005 and has also filed an application U/S 125 Cr.P.C for her maintenance. In counter blast this false case has been filed on behalf of the opposite party no. 2 against the applicant no. 1 and her other family members. In fact, the applicants have not committed any fraud. False story has been concocted by the complainant. It has further been submitted that the opposite party no. 2 and his family members have seen the documents regarding educational qualification of applicant no. 1. It has further been submitted that no case is made out against the applicants U/S 420 and 504 IPC. The applicants have falsely been implicated in the present case only for the purpose of harassment. The summoning order is not in accordance with law and is liable to be quashed.;
