VIVEK CHAUDHARY,J. - (1.) The petitioner was appointed as Assistant Grade III (Depot) in the year 1971 and after due promotion, he was working on the post of Assistant Grade I (Depot) since 1982.
(2.) The petitioner was served a charge sheet on allegation of misuse of fund of the Corporation on account of huge O.T.A. to the staff during short span of six months from October, 1993 to April, 1994.
(3.) Petitioner denied the said charges and an Inquiry Officer was appointed who by his enquiry report has found that the charges were not proved. However, a show cause notice was issued to petitioner on 24.10.2000 whereby Senior Regional Manager disagreed with the findings of the Inquiry Officer, holding Sri R.C. Gupta, Assistant Grade I (Depot) guilty of charge levelled against him. The relevant portion of the said show cause notice is quoted below:- "The undersigned, therefore, in view of the above points of disagreement with the findings of Inquiry Officer holds Sri R.C. Gupta, Asstt. Gr.I( (Depot), guilty of charge levelled against him. Shri R.C. Gupta, Asstt. Gr.I (D) is, therefore, directed to show cause why action should not be taken against him on said points of disagreement from the findings of Inquiry Officer." ;
